ESPC Comprehensive Training: Part 2

This course introduces attendees to the basics of measurement and verification (M&V) and why the U.S. Department of Energy's (DOE) Federal Energy Management Program (FEMP) places such as significant emphasis on this DOE ESPC IDIQ requirement. It consists of an overview of the various M&V options agencies can consider depending on their energy savings performance contract (ESPC) policy, program goals, and unique site and facility needs. An overview of phase three—project development—will be discussed including the request for proposal, investment grade audit, proposal development and review, and negotiations.

Attendees will review a unique DOE FEMP-developed tool to help agencies recognize and assign ESPC risks and responsibilities. The course was sponsored by DOE FEMP and taught by experts in the field of performance contracting including former federal contracting officers, federal project executives, DOE national laboratory experts, and other consultants with extensive background in ESPCs.

Tom Hattery, Federal Project Executive  

Since 2002, Tom Hattery has been a federal project executive for U.S. Department of Energy's Federal Energy Management Program. In this role, Tom assists federal agencies with alternatively financed energy improvements through vehicles such as energy savings performance contracts (ESPC) and utility energy savings contracts. He covers the mid-Atlantic and northeastern states and all U.S. State Department facilities worldwide. From 1997 to 2002, Tom was an assistant director in the Maryland Energy Administration where he managed several programs including Maryland's Energy Performance Contracting, Million Solar Roofs, Home Energy Rating System, and biomass fuel. Tom is a former president of the Energy Services Coalition, a national organization promoting ESPCs.

Russ Dominy, ESPC Instructor, BGS-LLC  

Russ Dominy is an experienced acquisition professional having served as the former acquisition director/chief of contracts office at NAVFAC Engineering and Expeditionary Warfare Center. Russ was the department head responsible for overall management of 50 employees, including 40 contracting personnel. Russ also has held positions as the supervisory contracting officer, procurement contracting officer (PCO), administrative contracting officer, contract specialist, acquisition manager, and contracting officer representative. Russ served as the PCO and source selection authority for all large contract actions including over $1B in ESPC contracts. Russ was responsible for Command Government Commercial purchase card consisting of more than $2 million in transactions annually.

Eusebio M. (Sam) Espinosa, Federal Contracting Officer, Boston Government Services  

Sam is a senior subject matter expert providing contract management services to federal agencies. Sam has more than 40 years of experience in all types of contracting and acquisitions ranging from small purchases, up to multi-billions, including base procurement purchasing supplies and equipment for the Air Force Weapons Laboratory. He served as the administrative contracting officer for the F-16 Program, involving several U.S. and foreign government agencies. He served as procuring/administrative contracting officer for the B-2 Program and administered R&D, full-scale development, and production contract while establishing the Contract Administrative Office. Sam was the senior contracting officer for the Ballistic Missile Office supporting Peacekeeper in Minuteman Silos and Small ICBM. He served as manager and senior contracting officer as well as principle contracting advisor for ESPCs at the U.S. Department of Energy's National Nuclear Security Administration.

Phil Voss, Senior Project Leader, National Renewable Energy Laboratory  

Phil Voss provides technical assistance for alternative financing programs and projects, supporting the the U.S. Department of Energy's Federal Energy Management Program ESPC, UESC, and distributed energy initiatives. His work includes cross-coordination of these initiatives, performance-period support for ESPC projects, training development and delivery, and efforts to advance implementation of energy sales agreements at federal facilities. Phil also has experience managing project technical assistance, strategic energy planning, and representing NREL with a range of federal and non-federal clients. Phil has a B.S. in architectural engineering from North Carolina A&T State University.

Schuyler Schell, Supervisor Project Procurement and Distribution Generation Services, Federal Energy Management Program (FEMP)  

Supervisor Project Procurement and Distributed Generation Services at the Federal Energy Management Program (FEMP), within the Energy Efficiency and Renewable Energy Office of the Department of Energy. FEMP assists federal agencies in their efforts to achieve high levels of energy and cost efficiency and resiliency in their facilities. Mr. Schell leads the FEMP Program relating to DOE's Energy Savings Performance Contracts, Utility Energy Services Contracts, Distributed Energy Project and Procurement support, DOE Utility Contract Oversight, and other initiatives. Before coming to the DOE in 2001, Mr. Schell served in a variety of capacities at a leading housing finance Government Sponsored Enterprise. Earlier in his career, Mr. Schell was Vice President for Secondary Marketing and Product Development for a Dallas based Mortgage Company and was an economist and the Director of Government Agency Relations for a trade association in Washington. He has an undergraduate degree in Economics from the State University of New York at Albany, and a Master of Planning Degree from the School of Architecture at the University of Virginia.

Learning Objectives

Upon completion of this training, attendees will be able to:

  • Describe why an agency needs M&V and why there is so much focus on M&V;
  • Explain the importance of the task order RFP and why it is a departure from standard contracting;
  • Identify the elements of the final proposal understanding that the contractor integrates findings from the IGA with the requirements stated in the IDIQ and task order RFP to produce the final proposal; and
  • Identify a key element for review in the Risk, Responsibility, and Performance Matrix.
